‘We have to get rid of the folks who are in the way’ — Senators speak at Bitcoin 2024

The two Republican senators claimed that if their party wins control of the Senate, they will stop the SEC’s “regulation by enforcement.”

Republican United States Senators Cynthia Lummis and Tim Scott spoke at the Bitcoin 2024 conference on July 26, stating that the current leadership of the Senate Banking Committee is “in the way” of American innovation, especially as it relates to Bitcoin. “We have to get rid of the folks who are in the way,” Tim Scott stated, implying that voters should throw out the Democratic majority in the November elections.

Senator Lummis claimed that if Republicans win a majority in the November elections, they will appoint Scott as Chairman of the Banking Committee, which will put an end to anti-Bitcoin (BTC) legislation coming out of that body. “Republicans are going to be in the majority next year,” she stated. “And Senator Tim Scott is going to be the chairman of the Senate Banking Committee.”

Scott vowed that if he is elected chairman, he will use his power to put pro-Bitcoin legislation up for a vote and pass it through the Senate if possible. “The one thing I will absolutely guarantee will be done is watching your legislation get a vote, pass the Banking Committee, and we’re going to fight to make it a law in the United States of America,” he stated, claiming that this would accomplish “setting Bitcoin free at home, [...] free at last.”

Biden misses chance to ‘correct’ position on crypto — Senator Lummis

United States Senator Cynthia Lummis claims that US President Joe Biden “doubled down on his administration’s failed policies.”

United States President Joe Biden has missed the opportunity to “correct” his position on cryptocurr assets by vetoing the repeal of controversial cryptocurrency accounting guidelines, according to pro-crypto U.S. Senator Cynthia Lummis.

“Congress gave the administration the opportunity to correct its position on crypto assets,” Lumiss declared in a May 31 statement on X following Biden’s decision to veto a Congressional resolution that would have overruled the U.S. Securities and Exchange Commission (SEC) Staff Accounting Bulletin (SAB) No. 121.

Lummis argued that Biden went against the "will of the American people" by intervening and preventing the guidelines from being revoked while noting her commitment to continue fighting the matter.

If the Justice Dept. prevails in the case against the cryptocurrency mixer, internet service providers and the post office may also be liable to transmitter requirements, they said.

United States Senators Cynthia Lummis and Ron Wyden have sent a letter to Attorney General Merrick Garland voicing their concern over the Justice Department’s (DOJ’) interpretation of money transmission licensing. 

As the bipartisan authors indicate in a footnote, this interpretation is being applied in the case against Roman Storm, co-founder of crypto mixer Tornado Cash, who has been charged with operating an unlicensed money transmission operation and other serious crimes.

The Bank Secrecy Act and the Treasury Department’s Financial Crimes Enforcement Network (FinCEN) clearly define money transmission as the acceptance and transmission of currency and other forms of value. Non-custodial crypto service providers do not meet the established definition of money transmitters, and the DOJ is thus acting contrary to the Treasury, muddying policy enforcement, the senators said.
