SEC’s Mark Uyeda has strong chance of becoming next chair — Lawyer

The SEC’s “Crypto Mom” Hester Peirce is unlikely to replace Gary Gensler as the new chair, crypto lawyer Jake Chervinsky said.

As Donald Trump prepares to take office as president of the United States in January 2025, the cryptocurrency community is speculating on the most likely candidates to lead the US Securities and Exchange Commission.

Mark Uyeda, an SEC commissioner, is seen as a strong candidate for the role, according to crypto attorney Jake Chervinsky in an X post on Nov. 6.

Commissioner Uyeda is known for criticizing the crypto regulatory approach by current SEC Chair Gary Gensler, having in October called his policies a “disaster for the whole industry.”

Congressman criticizes Gensler as most ‘destructive’ SEC chair during hearing

SEC Chair Gary Gensler faced criticism from lawmakers and agency members during a House Financial Services Committee hearing over his handling of crypto regulation in the United States.

United States Congressman Tom Emmer slammed SEC Chair Gary Gensler during a congressional hearing, calling him the most “destructive” and “lawless” Chair in the regulator’s 90-year history.

“You’ve made up the term crypto asset security. This term is nowhere to be found in statute, you made it up [and] you never provided any interpretive guidance on how crypto asset security might be defined within the walls of your SEC,” Emmer told Gensler before a House Financial Services Committee hearing on Sept. 24.

Emmer said the term had served as the entire basis for Gensler’s “enforcement crusade” against the crypto industry for the last three years. This was up until last week when SEC lawyers retracted the term in a court footnote.

Solana ETF possible with a change in POTUS, SEC: Balchunas

Two industry pundits believe a change in SEC Chair is needed to even entertain the idea of a spot Solana ETF.

A spot Solana (SOL) exchange-traded fund in the United States may only be possible with a change in the administration and the head of its securities regulator, according to Bloomberg ETF analyst Eric Balchunas.

On June 27, ETF issuer VanEck made a surprise move to file for a spot Solana ETF with the United States Securities and Exchange Commission.

Matthew Sigel, head of digital assets research at VanEck, said the new fund, called the VanEck Solana Trust, aims to capitalize on Solana’s decentralized nature, high utility and economic feasibility.

Spot Ether ETFs will come down to a 5-person vote: Gensler the decider?

It was speculated that Gensler’s vote secured the launch of spot Bitcoin ETFs in January — and the same five commissioners are set to vote on Ether ETFs this week.

The fate of spot Ether (ETH) exchange-traded funds could be decided this week by a single vote from Gary Gensler, the chair of the United States Securities and Exchange Commission — if history is any indication.

In January, the approval of spot Bitcoin ETFs came down to a five-commissioner panel. Two crypto-friendly commissioners, Hester Pierce and Mark Uyeda, voted to approve ETFs, while Commissioners Caroline Crenshaw and Jaime Lizárraga voted against them.

Gensler also voted to approve it, leading many to believe his vote ultimately secured approval of spot Bitcoin ETFs, which were approved with a 3-2 vote on Jan. 10, 2024.
