House Republicans urge SEC to rescind ‘disastrous’ SAB 121

The House and Senate Republicans claimed the SEC evaded the notice and comment rulemaking process required by the Administrative Procedure Act by issuing SAB 121.

More than 40 United States Republicans have called on the US securities regulator to rescind its “disastrous” Staff Accounting Bulletin No. 121 rule after a repeal bill received bipartisan support before being vetoed.

SAB 121 upends custody rules for cryptocurrencies, weakens consumer protections, and stifles financial innovation, House Financial Services Committee Chair Patrick McHenry, Senator Cynthia Lummis and 40 other politicians claimed in a Sept. 23 letter to the Gary Gensler-led Securities and Exchange Commission.

The 42 politicians further claimed that SAB 121 — a proposed rule mandating that SEC-reporting entities custodying cryptocurrencies must record those holdings as liabilities on their balance sheets — was issued without consulting any “prudent regulators” and that the accounting approach “deviates from established accounting standards.”

US senators urge CFTC to finalize ban on election betting

It comes as decentralized prediction platform Polymarket has gathered more than $500 million in bets on who will likely win the 2024 United States presidential election.

Five United States Senators and three House representatives have renewed calls for the commodities regulator to ban betting on the 2024 presidential election.

They claimed that such markets “could influence and interfere with elections and further erode public trust in democracy” in an Aug. 5 letter to the Commodity Futures Trading Commission Chair, Rostin Benham.

“We urge you to promptly finalize and implement this rule to prevent the commodification of U.S. elections.”

Crypto donations raised by Hamas ‘remain tiny,’ says Elliptic

Elliptic’s statement was framed as a rebuttal to recent articles and letters circulating among the media and U.S. lawmakers this month.

Blockchain forensic firm Elliptic says there’s “no evidence” that Hamas is receiving a significant volume of cryptocurrency donations to fund its attacks against Israel.

“There is no evidence to support the assertion that Hamas has received significant volumes of crypto donations,” Elliptic said in an Oct. 25 statement. The amounts raised “remain tiny,” the firm added.

Elliptic’s statement was framed as a rebuttal to recent articles and letters written by The Wall Street Journal and United States lawmakers, which the firm says had misinterpreted data to make the case that cryptocurrency is widely used to fund Hamas’ "terrorist” activities.

As an example, Elliptic pointed to a “prominent” Hamas cryptocurrency fundraising campaign, operated by Gaza Now, a pro-Hamas news outlet, which has only raised $21,000 since the Hamas attack on Israel on Oct. 7.

Of the $21,000 raised, $9,000 was frozen by stablecoin issuer Tether, while another $2,000 was frozen after it was sent to a cryptocurrency exchange — presumably to cash out, Elliptic noted.

Elliptic said it reached out to WSJ to correct a statement that initially claimed that over $130 million in cryptocurrency was raised by Hamas and Palestinian Islamic Jihad between Aug. 2021 and June 2023. WSJ later revised the statement to say “as much as $93 million” in an Oct. 10 update.

The WSJ article had been cited in a letter written by Elizabeth Warren and over 100 other U.S. lawmakers to the White House and U.S. Department of the Treasury on Oct. 17.

Warren and other lawmakers argued that cryptocurrency poses a “national security threat” to the U.S. and its allies and that Congress and the Biden administration must take “strong action” to thoroughly address risks with cryptocurrencies in facilitating illicit activity before it can be used to finance another “tragedy.”

However, Elliptic reiterated that its data was misinterpreted:

“Over the past two weeks, politicians and journalists have portrayed public crypto fundraising as a significant source of funds for Hamas and other terrorist groups, but the data simply does not support this.”

On Oct. 18, blockchain forensics firm Chainalysis also posted a blog attempting to address supposed misconceptions circulating in the media. One particular wallet highlighted by media reportedly received $82 million across 7 and a half months, but Chainalysis explained that of that, only $450,000 was transferred to a known terror-affiliated wallet.

Meanwhile, Elliptic also noted that in April 2023, Hamas suspended cryptocurrency fundraising conducted through Bitcoin (BTC), citing a “concern about the safety of donors and to spare them any harm.”

In 2021, Israel’s National Bureau for Counter Terror Financing also began issuing seizure orders for cryptocurrency wallets tied to Hamas and worked with exchanges to freeze accounts used by them.

These events suggest cryptocurrency isn’t an ideal means to facilitate terrorism fundraising, Elliptic argued:

“This illustrates the weakness of crypto as a terrorism fundraising tool. The transparency of the blockchain allows illicit funds to be traced, and in some cases linked to real-world identities.”

Grayscale urges SEC to approve all Bitcoin ETFs simultaneously

Grayscale's ETF was previously knocked back by the SEC and it wants it and competing ETFs approved together so none have an advantage.

Crypto fund manager Grayscale is urging the Securities and Exchange Commission (SEC) to approve all proposed spot Bitcoin (BTC) exchange-traded funds (ETFs) at the same time to avoid one having an advantage.

A July 27 post by Grayscale chief legal officer Craig Salm said its legal team submitted a letter regarding eight spot Bitcoin ETF filings — including its own — arguing the SEC shouldn’t pick “winners and losers” and instead make a fair and orderly decision.

The letter claimed the SEC could approve the spot ETFs based on its approvals for Bitcoin futures ETFs saying the two fund types are “inextricably linked.”

Grayscale added recent surveillance sharing agreements (SSAs) between Coinbase and the spot ETF providers are “not a new idea” and claimed they would not meet the SEC’s standards.

ETF filings from Invesco, BlackRock, Valkyrie, VanEck, Wisdom, Fidelity and ARK Invest were recently updated to include SSAs with Coinbase.

Coinbase would share information on its trading books and other information so the SEC can monitor any possible market manipulation or irregular trading activity.

In late June SEC pushed back on the ETFs due to there being no SSAs, saying they were needed due to what it claimed was the potential for crypto markets to be manipulated.

Grayscale claimed, however, that the SSA’s “would neither satisfy nor be necessary” under the SEC's standards as Coinbase isn’t registered with the SEC as a securities exchange or broker-dealer nor with the Commodity Futures Trading Commission (CFTC) as a futures exchange.

It added approving the ETFs would be “a positive but sudden and significant change” in the SEC's application of its standard and would “improperly grant an unfairly discriminatory and prejudicial first-mover advantage to these proposals.”

The Grayscale Bitcoin Trust (GBTC), which aims to track Bitcoin’s price, has nearly 1 million investors, Salm claimed.

He said if it's converted to an ETF it would return billions in value to investors, adding there’s “simply no reason” the SEC should keep GBTC investors from a spot Bitcoin ETF.

The SEC denied Grayscale’s application to convert the GBTC to a spot Bitcoin ETF last June.

In response, Grayscale sued the regulator saying it was acting arbitrarily by “failing to apply consistent treatment to similar investment vehicles.

SEC asks for more time to respond to Coinbase call for crypto clarity

The securities regulator said it would make a recommendation within 120 days on Coinbase’s rulemaking request, but says the action has “no merit.”

The United States securities regulator has asked for four more months to provide a response to Coinbase’s request for crypto regulatory clarity.

In a June 13 letter submitted to the U.S. Court of Appeals for the Third Circuit, the Securities and Exchange Commission (SEC) said it needs an additional 120 days to reply to Coinbase’s request that it adopt new rules and provide further clarity on the laws governing crypto.

The letter was in response to the court’s June 6 order to the SEC which asked the regulator to address if it’s denying the rulemaking or if it needs more time to respond.

The SEC said it “has not decided what action to take on that petition in whole or in part” and claimed Coinbase’s request for a writ of mandamus has “no merit.”

The regulator claimed that the mandamus petition “should be denied” but anticipated it would be able to make a recommendation on Coinbase’s petition for rulemaking “within the next 120 days.”

In response to the letter, Coinbase chief legal officer Paul Grewal informed his 40,000 Twitter followers that the SEC had repeated the “fallacy” that it was yet to decide on any new regulation.

He added the letter ignored clear statements from SEC chair Gary Gensler that the SEC has “no intent to issue new rules.”

“[The SEC] instead conflate the evidence of a decision those statements provide with an argument that the statements are themselves a decision,” Grewal said.

“They refuse to commit to any deadline despite the Court's explicit order,” Grewal added.

The court’s order to the SEC came the same day the regulator sued Coinbase for offering unregistered securities and operating an unregistered securities exchange.
