Shaquille O’Neal may still be in hot water over Astral NFTs, says judge

A Miami judge didn’t dismiss a claim that basketball legend Shaquille O’Neal was a “seller” of Astrals NFTs and found they could be securities under US law.

Former pro basketball player Shaquille O’Neal will need to defend some of the claims brought against him in the Astral non-fungible token (NFT) class-action lawsuit.

The lawsuit, which has been ongoing for over a year, names O’Neal as a defendant. It alleges that the NFTs are unregistered securities that O’Neal once promoted online. 

In an Aug. 16 order on O’Neal’s motion to dismiss, Miami federal court judge Federico Moreno judged the plaintiffs properly alleged that O’Neal was a “seller” of the Astrals NFT project, meaning O’Neal will need to answer for that.

FTX seeks to reverse payments made to Shaq, Naomi Osaka and Miami Heat

FTX laid out the millions it paid to the likes of Shaquille O’Neal, Naomi Osaka and other high-profile people it’s looking to get back.

Bankrupt crypto exchange FTX is probing if it can reclaim the millions of dollars paid to celebrity athletes and sports teams that promoted the exchange before it filed for bankruptcy last November.

In an over 180 page Aug. 31 court filing, FTX’s financial advisors laid out a detailed list of high-profile figures and businesses it paid in its marketing efforts to see if they’re under rules allowing bankrupt companies to reverse the payments.

The list includes $750,000 made to former basketball pro Shaquille O’Neal, over $300,000 to Tennis pro Naomi Osaka, over $270,000 to former baseball star David Ortiz and over $200,000 to American football quarterback Trevor Lawrence.

Also included are nearly $420,000 made to pro basketball team the Golden State Warriors and over $250,000 in various payments to Miami Heat.

The filing warned, however, that the final amount FTX may recover from the efforts “may vary materially from the amount reported.”

Many of the celebrities named in FTX’s recent filing have faced class action lawsuits from FTX users seeking damages.

O’Neal, Osaka and the Golden State Warriors have been sued by groups of FTX customers over allegedly promoting the exchange — which they claim sold unregistered securities.

The exchange has launched a series of lawsuits to try recover funds with the most recent on Sep. 9 against cross-chain protocol LayerZero Labs in a bid to claw back $21 million that FTX alleged was illegally withdrawn prior to the exchange's bankruptcy in November last year.

In July it sued co-founder Sam Bankman-Fried and other former top executives to try to recover more than $1 billion in funds they allegedly misappropriated.

UK uses Love Island star to warn finfluencers on crypto and investment schemes

The financial and advertising regulators posted a seven-part checklist to ensure these social media stars stay within the bounds of the law.

The financial and advertising regulators of the United Kingdom have teamed up to send a warning to social media “finfluencers” telling them to stop promoting illegal “get rich quick” schemes or face law enforcement.

The Financial Conduct Authority (FCA) and the Advertising Standards Authority (ACA) made reference to cryptocurrencies and nonfungible tokens in their April 6 statement, which laid out a seven-part checklist to ensure that finfluencers stay within the bounds of the law.

The checklist asks finfluencers to consider whether they’re the “right person” to be promoting the financial product and states that their followers may “lose all their money” from the investment. It also states:

“Don’t suggest to your followers that cryptoassets would be an easy investment decision or create any sense of urgency or FOMO.”

In addition to conducting “due diligence,” social media influences should seek approval of the FCA and ensure that the advertisement is legal, truthful and properly labeled as an advertisement under ASA rules.

The FCA and ACA strongly advised that influencers check ScamSmart to ensure that they’re not promoting an investment scam. “If in doubt, don’t promote”, the checklist’s slogan states.

It is a crime to unlawfully promote financial products or services which carries a maximum sentence of two years’ imprisonment and an unlimited fine:

“If your post breaks the rules, the ASA will take action.”

Sarah Pritchard, the FCA’s executive director, explained that there has been a spike in illegal financial promotions of late.

“They are often doing this without knowledge of the rules and without understanding of the harm they could cause their followers,” she added.

The FCA and ASA partnered with former U.K. Love Island contestant Sharon Gaffka to emphasize the risks that come with lucrative marketing schemes.

The FCA will also host an “open roundtable discussion” with influencer agents and the Influencer Marketing Trade Body in the coming months.

Across the channel, France is edging closer to banning French social media influencers from promoting cryptocurrencies and NFTs from unlicensed firms after the National Assembly’s economic committee voted in favor of an amendment proposal on March 23.

If passed, the new law would add crypto assets to a list of prohibited products, such as gambling and pharmaceuticals, that cannot be promoted by influencers.

Those found to violate the incoming law may also be subject to two years’ imprisonment with a fine of 30,000 Euros ($32,300).

Reality TV star Kim Kardashian, boxing legend Floyd Mayweather and internet celebrity Jake Paul are some of the most notable figures to have found themselves embroiled in allegedly promoting crypto investment schemes.

Texas to probe FTX endorsements by Tom Brady, Stephen Curry and other celebs

The Texas State Securities Board is scrutinizing payments received by celebrities to endorse FTX US, as part of a wider probe into FTX's collapse.

NFL quarterback Tom Brady and NBA point guard Stephen Curry are reportedly among the celebrities facing a probe from the Texas financial regulator over their promotion of the now-bankrupt crypto exchange, FTX. 

Joe Rotunda, director of enforcement at the Texas State Securities Board reportedly told Bloomberg in a Nov. 22 report that the Texas State Securities Board is scrutinizing payments received by celebrities to endorse FTX US, what disclosures were made and how accessible they were for investors.

Rotunda however noted that while the watchdog was taking a "close look at them," the celebrities’ endorsements of FTX were not an "immediate priority,” but would be part of the “regulator's larger probe into FTX's collapse."

Both Brady and Curry have also been named in a Nov. 15 class-action lawsuit against FTX, along with former FTX CEO Sam Bankman-Fried.

The lawsuit alleged that they “controlled, promoted, assisted in, and actively participated” in FTX Trading LTD and West Realm Shires Services Inc.

Others named in the class action include model Gisele Bundchen, the Golden State Warriors basketball team, NBA player Udonis Haslem and co-creator of Seinfeld Larry David.

Cointelegraph reached out to the Texas State Securities Board for comment but did not receive a reply before publication.

In the past surveys have found that nearly half of retail investors will follow digital asset advice from the social media accounts of celebrities and influencers without question, and this has seen more than a few use their influence to shill crypto products and projects.

In October, reality TV star Kim Kardashian was fined by the United States Securities and Exchange Commission (SEC) for “touting on social media” about the EMAX without disclosing she was paid $250,000 to post about it.

Kardashian has neither admitted to nor denied the SEC’s allegations, but settled the charges and agreed to not promote any cryptocurrency assets until 2025.
