EU markets watchdog urges amendments to MiCA crypto regulations

The European Securities and Markets Authority acknowledged the legal limitations raised by the European Commission but emphasized the importance of the framework’s initial objectives.

The European Union’s markets watchdog believes that the bloc’s cryptocurrency regulatory framework, the Markets in Crypto-Assets Regulation (MiCA), needs to be modified.

On Oct. 16, the European Securities and Markets Authority (ESMA) released an official opinion on MiCA, encouraging the European Commission to move forward with its proposal to update several aspects of the framework.

“ESMA acknowledges the legal limitations raised by the Commission but emphasizes the importance of the policy objectives behind the initial proposal,” the regulator wrote.

21Shares urges EU to change ‘inconsistent’ crypto ETP rules

The ETP issuer is asking for more clarity and consistency from what it claims is the European Union’s “patchwork” of crypto regulations.

Crypto exchange-traded product (ETP) issuer 21Shares has pushed for European Union regulators to create a unified regulatory framework for the inclusion of crypto in investment products.

On Oct. 7, 21Shares urged the European Securities and Markets Authority (ESMA) to adjust its rule to include crypto assets in Undertakings for Collective Investment in Transferable Securities (UCITS) funds designed for retail investors, such as ETPs and exchange-traded funds (ETFs).

Current EU regulations for including crypto in these types of funds are inconsistent and vary across countries, causing confusion and inconsistencies for investors, 21Shares claimed.

Pudgy Penguins CEO unfazed by SEC actions against the NFT sector

While the SEC focuses on investor protection, Pudgy Penguins CEO Luca Schnetzler believes that investors should also hold some form of accountability for their purchases. 

Pudgy Penguins CEO Luca Schnetzler, widely known in the NFT space as Luca Netz, stated that he remains unfazed by the recent actions taken by the U.S. Securities and Exchange Commission (SEC) against the NFT industry.

On Aug. 28, NFT marketplace OpenSea revealed that it had received a Wells notice from the SEC. The company claimed that the SEC is alleging that NFTs on the trading platform may qualify as securities. Then, on Sept. 17, the SEC imposed a $750,000 fine on the restaurant Flyfish Club for offering NFTs.

As the SEC takes action against the industry, some argue that it is necessary to respond to these measures. However, Schnetzler dismisses the SEC’s actions as “nonsense.”
