US trustee challenges FTX reorganization plan, citing legal concerns

The objections raised by the US trustee and the creditor group are likely to play a significant role in the court’s deliberations.

The ongoing FTX reorganization proceedings have taken a new turn as the United States trustee overseeing the case has raised significant objections to the crypto exchange’s amended reorganization plan. 

The trustee, Andrew Vara, along with a group of creditors, has filed complaints highlighting multiple flaws in the proposed plan, which the FTX estate has touted as having widespread creditor support.

This follows a claim by the bankrupt crypto trading platform FTX that its amended reorganization plan gained overwhelming preliminary support from creditors entitled to vote.

FTX and CFTC agree to $12.7B settlement, subject to court approval

The US commodities regulator didn’t seek a civil monetary penalty, meaning the entire $12.7 billion would be used to pay back FTX’s creditors.

Bankrupt cryptocurrency exchange FTX and the United States commodities regulator have agreed to a $12.7 billion settlement, resolving a 19-month long lawsuit.

The agreement comes after months of back-and-forth negotiations and is now only subject to court approval, a recently released July 12 filing shows.

"The Proposed Settlement is an integral and valuable component of the Debtors’ proposed chapter 11 reorganization plan," said Commodity Futures Trading Commission senior trial attorney Carlin R. Metzger and FTX’s CEO John. J Ray III.

Gemini creditors revolt over ‘brutal’ Bitcoin slashing reorg plan

Under the proposed plan, Gemini Earn users may only recover 61% of their lost funds in a worst-case scenario.

Gemini Earn creditors are fuming over a proposed reorganization plan that could see their promised Bitcoin (BTC) payouts effectively slashed to about 30% of what they’re worth at current market rates.

In an X post, Gemini Trust revealed it sent creditors an email on Dec. 13 outlining the proposed plan, which has now been put up for a vote.

Under the proposed plan, creditors will receive a payout equal to their Earn crypto balances as of Jan. 19, 2023 — the date that Gemini’s cryptocurrency lending partner Genesis Global Capital filed for bankruptcy.
