Osprey Funds to seek SEC approval to convert Bitcoin trust into ETF

In a separate statement, Osprey said that the deal for Bitwise to acquire the Osprey Bitcoin Trust had been scuttled after failing to get the necessary regulatory approvals.

Investment management firm Osprey Funds has flagged a plan to convert its Osprey Bitcoin Trust (OBTC) into an exchange-traded fund (ETF) after the deal to be acquired by Bitwise was terminated.

In a Jan. 14 statement, the firm said it will file a Form S-1 containing a registration statement with the US Securities and Exchange Commission “as soon as practicable.”

OBTC was once a competitor to the much larger Grayscale Bitcoin Trust before GBTC eventually converted to a spot Bitcoin ETF in January 2024.

SEC simultaneously approves Hashdex, Franklin’s Bitcoin-Ether ETFs

Securities exchange NYSE Arca has expressed interest in listing a Grayscale crypto index ETF holding a diverse basket of spot crypto but has yet to receive approval.

The United States Securities and Exchange Commission (SEC) gave the green light to Hashdex and Franklin Templeton’s respective Bitcoin and Ether index exchange-traded funds (ETFs).

In a Dec. 19 notice, the SEC approved Hashdex’s Nasdaq Crypto Index US ETF, which will trade on the Nasdaq stock market. The regulator also approved the Franklin Crypto Index ETF, which is destined for the Cboe BZX Exchange.

Both indexes will hold spot Bitcoin (BTC) and spot Ether (ETH). The Franklin Crypto Index ETF tracks the Institutional Digital Asset Index, a benchmark designed to represent the performance of digital assets such as Bitcoin and Ether. Hashdex’s Crypto Index ETF will track Bitcoin and Ether, which are included in the Nasdaq Crypto US Settlement Price Index.

Be persistent with the SEC, says Franklin Templeton digital asset head

The SEC is safeguarding the economy, but Roger Bayston sees a change in tone at the regulator.

Financial innovators are playing the long game with the United States Securities and Exchange Commission (SEC), and it’s only fair, according to Franklin Templeton head of digital assets Roger Bayston.

“The SEC, like a lot of regulatory bodies, likes to rely on legal precedents. […] Those precedents are being set in courts of law oftentimes, so this is just the process we’re engaged in,” Bayston told Cointelegraph’s Turner Wright at the Consensus event.

Despite frequent expressions of cynicism about the SEC’s “open door” policy, Bayston saw the agency’s behavior as safeguarding the economy and not insurmountable:

Outflows from the Grayscale Ethereum Trust (ETHE) could dampen the Spot Ethereum ETF approval party but create significant opportunities for traders.

In a surprise for markets, the U.S. Securities and Exchange Commission (SEC) approved eight spot Ethereum ETFs on May 23, leading to a wave of positive sentiment.

But perhaps even more surprisingly, the Ether (ETH) price barely reacted to the news.

Before the SEC announcement on May 23, the price of Ether was $3,742.31. It rose to $3,959.28 on May 27 before falling to $3859.39 on May 28. A consistent bull run has yet to emerge.
