SEC defends amended suit against Binance, CZ over securities claims

In the latest round of the SEC suit against Binance, Binance.US and CZ, the agency has largely repeated itself in a form more acceptable to the court.

The United States Securities and Exchange Commission (SEC) has responded to a motion for the dismissal of its amended suit against cryptocurrency exchanges Binance and Binance.US and former Binance CEO Changpeng Zhao alleging they operated an unregistered securities exchange. The allegation is based on the sale of ten cryptocurrencies on the secondary market intermediated with the exchange’s BNB coin.

The SEC filed an amended complaint after Judge Amy Berman Jackson in the US District Court for the District of Columbia questioned the reasoning in a complaint making the same allegations. The Binance exchanges and Zhao filed a motion for the dismissal of the complaint on Nov. 4.

The SEC’s Memorandum of Law opposing the motion to dismiss responds to their claim that the SEC complaint does not plausibly produce facts to satisfy the Howey test. The memorandum discusses each prong of the test and reiterates the SEC’s position on them.

Binance, WazirX among crypto firms evading taxes in India, says gov’t

India has recovered $14 million in goods and services tax from crypto firms like WazirX, but Binance has yet to pay its $85 million tax evasion liabilities, the minister said.

The Indian government has detected a significant amount of unpaid goods and service taxes (GST) by major cryptocurrency exchanges, including Binance and WazirX.

India’s Minister of State for Finance, Pankaj Chaudhary, said the government has found 824 crore Indian rupees ($97 million) in GST in unpaid taxes by several crypto exchanges, The Economic Times reported on Dec. 3.

Authorities have reportedly initiated multiple related investigations into crypto exchanges, including WazirX, CoinDCX and CoinSwitch Kuber.

Binance leads crypto exchanges in Bitcoin deposits in 2024

Average Bitcoin and USDT deposits across crypto exchanges escalated over the year, indicating a rise in institutional demand for digital assets.

Cryptocurrency exchanges have seen a sharp increase in average deposits in 2024, driven by larger purchases from professional and corporate investors. 

According to a Dec. 3 analysis by CryptoQuant, Binance saw its average daily Bitcoin (BTC) deposit rise by 2.77 BTC over the year, outpacing competitors like Kraken and Coinbase — with average daily deposits up by 0.56 BTC and 0.41 BTC, respectively.

Data across exchanges shows that average Bitcoin deposits escalated from 0.36 BTC in 2023 to 1.65 BTC in 2024, while deposits with Tether (USDT) stablecoin surged from $19,600 to $230,000, indicating growing participation from institutional investors and market makers inflows to exchanges.

Changpeng Zhao says he ‘wouldn’t mind a pardon’ from Donald Trump

The former Binance CEO already pleaded guilty to one felony charge and served four months in prison, but receiving a presidential pardon could present certain opportunities.

Former Binance CEO Changpeng “CZ” Zhao suggested that he would be open to receiving a federal pardon from United States President-elect Donald Trump for a felony charge.

In a Dec. 1 reply to TelosX co-founder John Lilic on X, Zhao said he “wouldn’t mind a pardon” from Trump, who is scheduled to be inaugurated as the 47th US President on Jan. 20.

As part of a settlement with authorities in November 2023, the former Binance CEO pleaded guilty to a criminal charge related to his failure to maintain an effective Anti-Money Laundering program at the crypto exchange.

Nothing is ‘guaranteed’ with a memecoin listing — Binance CMO

Binance CMO Rachel Conlan says that "community feedback and input" are important factors for crypto exchanges when deciding which cryptocurrencies to list, though nothing is "guaranteed."

The surge in memecoin popularity in recent times has added extra pressure on crypto exchanges to weed out questionable projects and protect users, according to a crypto exchange executive.

“The team does a lot of due diligence on the founders of the project, who is involved, and what’s potentially on their roadmap,” crypto exchange Binance chief marketing officer Rachel Conlan told Cointelegraph at Aus Crypto Con 2024.

As for what is the X factor that gets a crypto token listed on Binance, Conlan said there is nothing "guaranteed.”
